Thank you for subscribing to the Identity Theft Resource Center’s (ITRC) Breach Alert for Business (BA4B) service. For purposes of this agreement, “You” and “Your” refer to your organization and its use of the BA4B service. “Identity Theft Resource Center,” “ITRC,” “Breach Alert,” a service of the ITRC, “BA4B,” and “We,” and “Our,” refers to the Identity Theft Resource Center, Inc. of San Diego, California, a nonprofit organization.
By subscribing to the BA4B service, you agree to the following Terms of Service, specifically:
- You acknowledge the ITRC is extending to you a limited, nonexclusive, non-transferable license to access the ITRC’s searchable database of publicly reported data breaches; the ability to search the data breach history of organizations; and to register an unlimited number of organizations for which you will receive notifications via email in the event a registered organization is entered into the ITRC database of publicly reported data breaches.
- You acknowledge that the ITRC gathers information about publicly reported data breaches from credible sources dating back to 2005 and offers access to this information through a searchable database, also known as Breach Alert.
- You acknowledge the information contained in the Breach Alert database is offered “as is” and the ITRC does not guarantee the accuracy of the information reported. The source(s) of information is listed for each data breach entered into the Breach Alert database. Sources include, but are not limited to, government agencies, news media outlets, entity news releases, entity websites, government filings, general publications, industry and trade websites, recognized cybersecurity and privacy researchers, and direct notices provided by consumers or companies.
- You acknowledge that there is a time delay between when a data breach occurs, when an organization discovers a data breach, when a data breach notification is publicly issued or revealed by a third party, and when the notice and available details are entered into the Breach Alert database. The Breach Alert database is updated on a daily basis, Monday through Friday except holidays, and on weekends in the event of a significant data breach.
- We acknowledge that we will keep confidential and secure the information you provide, including but not limited to logs of notified searches, the names of registered companies designated for alerts, company contact information, and payment information.
- You acknowledge and agree that the term of this subscription is 365 days from the date of payment; you further acknowledge and agree that this subscription will automatically renew and payment will be processed each year on the anniversary date of this subscription until such time you give 60 days’ notice of non-renewal by email to [email protected].
- You acknowledge the price of the annual subscription shall remain fixed for a period of two years from the original subscription date. The ITRC will provide notice of a price increase, if any, at least 120 days prior to any subsequent renewal period.
- You acknowledge that you may cancel your subscription at any time, and you further acknowledge you will continue to have access to the Breach Alert searchable database and receive breach alerts until the anniversary date of the original subscription without refund.
- You acknowledge that in the unlikely event we have a dispute over the terms of this use for this service all disputes will be heard in the state and federal courts of California.
You will be asked to “Click to Subscribe” after completing an online registration form and providing payment information. By checking an acknowledgment box and clicking on the submit button, you are agreeing to the Terms of Service outlined here.
